1. Scope
These Terms apply to hemangvyas.com and the portfolio projects, demos, websites, APIs, dashboards, and mobile apps operated by Hemang Vyas unless a separate signed agreement, app-store agreement, customer contract, or project-specific terms apply.
By accessing or using a service, you agree to these Terms. If you use a service for a company or organization, you confirm that you are authorized to do so.
2. Portfolio, Demo, Prototype, and Production Status
Many listed products are portfolio builds, prototypes, in-development systems, testnet deployments, internal tools, or demo environments. They may change, be suspended, contain placeholder data, or have limited support unless a production agreement says otherwise.
Do not rely on demo or prototype systems for production operations, legal compliance, financial decisions, medical decisions, food-safety certification, tax reporting, or irreversible blockchain transactions without a separate written agreement and independent review.
3. Accounts and Security
You are responsible for keeping login credentials, API tokens, mobile devices, private keys, integration credentials, and BYOK AI provider keys secure. You must notify info@hemangvyas.com if you suspect unauthorized access.
Access may be restricted, suspended, or removed where necessary to protect systems, users, data, or legal obligations.
4. Acceptable Use
You must not misuse the services, attempt unauthorized access, scrape or overload systems, upload malicious content, bypass security controls, interfere with other users, violate third-party rights, or use the services for unlawful, harmful, deceptive, or abusive activity.
You must not submit secrets, regulated data, health data, financial data, personal data of others, or business-confidential data unless the relevant service is designed and authorized to receive it.
5. Project-Specific Boundaries
DaGBnB and its mobile app involve Kaspa, escrow concepts, wallet flows, and testnet-first blockchain workflows. They are not custodial financial, legal, or real-estate brokerage services unless separately agreed in writing.
VedaQuity and its mobile app provide portfolio management and AI-assisted information tools. They do not provide regulated investment, tax, accounting, or financial advice.
VeriMilk web and mobile workflows are screening and data-management tools. They do not replace certified laboratory testing, official food-safety determinations, or professional quality-control obligations.
LigaPhysio content supports yoga, physiotherapy presentation, classes, events, and inquiries. It does not replace emergency care, diagnosis, or individualized medical treatment.
EuroServe, NexusSync, SymbioPulse, HV Hub, HiveMem, Brand Core, and SingleFoundry support operational, integration, commerce, AI, memory, and data workflows. Users remain responsible for validating outputs, compliance settings, third-party API permissions, fiscal rules, and automation actions before production use.
6. Fees, Orders, and Paid Work
Portfolio browsing is free unless otherwise stated. Paid development, licensing, hosting, support, subscriptions, custom integrations, and production operations require a separate written proposal, order, invoice, subscription, or contract.
Fees, taxes, refunds, service levels, deliverables, and ownership terms are governed by the relevant written agreement.
7. Intellectual Property
The websites, designs, code, copy, documentation, trademarks, logos, screenshots, and project concepts remain owned by Hemang Vyas or their respective licensors unless a written agreement states otherwise.
You may not copy, redistribute, reverse engineer, remove attribution, or use project assets commercially without permission. Third-party frameworks, templates, icons, APIs, and libraries remain subject to their own licenses.
8. User Content and Data
You retain rights to content and data you submit. You grant Hemang Vyas the limited rights needed to host, process, display, transmit, back up, secure, and support that content in connection with the service you use.
You are responsible for ensuring that you have the rights and permissions needed to submit content, credentials, images, records, customer data, merchant data, restaurant data, project memory, or other materials.
9. Third-Party Services
Projects may connect to third-party services such as app stores, payment processors, hosting providers, email providers, Firebase, AI providers, Shopify, Shopware, Amazon SP-API, eBay, Kaspa infrastructure, or other APIs. Their own terms and privacy policies apply.
Hemang Vyas is not responsible for third-party service outages, API changes, review decisions, account restrictions, pricing changes, or data handling outside direct control.
10. Availability and Changes
Services are provided on an as-available basis unless a written agreement states otherwise. Features, routes, mobile builds, APIs, integrations, test accounts, demo data, and deployments may change or be removed.
Reasonable efforts may be made to maintain public portfolio availability, but uptime, support response, backups, and recovery commitments require a separate agreement.
11. Disclaimers and Liability
To the maximum extent permitted by law, services are provided without warranties of uninterrupted operation, error-free results, fitness for a particular purpose, financial outcome, medical result, legal compliance, or third-party API continuity.
Nothing in these Terms excludes liability that cannot be excluded under mandatory law. For all other claims, liability is limited to direct damages caused by intentional misconduct or gross negligence unless a separate written agreement provides otherwise.
12. Termination
Access may be terminated or suspended if these Terms are violated, if a service is discontinued, if a project is moved to a different environment, or if continued access creates legal, security, operational, or reputational risk.
13. Governing Law and Contact
Unless mandatory consumer or local law requires otherwise, these Terms are interpreted under German law. Mandatory rights remain unaffected.
